CINNABON TURKEY CARD PROGRAM MEMBERSHIP APPLICATION FORM AND TERMS OF USE

This Membership Agreement is hereby executed by way of digital requirements and acceptance method and designed to provide Cinnabon Turkey Card members with the means to shop in Cinnabon Turkey stores in the territory of Turkish Republic and/ or various advantages (“Advantage(s)”) to be decided by Sadik Group, including eligibility to all campaigns and promotions, winning/ spending points, eligibility to gift vouchers and discounts by loading money to Cinnabon Turkey cards under this Cinnabon Turkey Card Program (“Program”) organized by Sadik Group Yatirim ve Insaat Ltd. Sti. (“Sadik Group”). Unless otherwise is expressly defined herein, capitalized words and terms shall have the meanings given to them in Terms of Use.

BOTH PARTIES HEREBY AGREE AND APPROVE THIS AGREEEMENT AT THEIR OWN WILL AND DISCRETION AND FURTHER AGREE THAT IT IS LEGALLY BINDING FOR THEM.

BEFORE YOU REGISTER AS A MEMBER AND GIVE YOUR APPROVAL, PLEASE READ THIS AGREEMENT CAREFULLY AND MAKE SURE THAT IT COVERS ALL THE THINGS YOU WISH AND DO NOT CONTAIN ANY PROVISION THAT IS AGAINST YOUR INTERESTS.

BY BECOMING A MEMBER OF THE PROGRAM AND USING CINNABON TURKEY CARD, YOU HEREBY STATE THAT YOU HAVE ACCEPTED THE GENERAL TERMS OF PROGRAM BELOW.

DEFINITIONS:

Focus Brands Group Companies: includes all affiliates, parent companies, subsidiaries of Focus Brands, including Sadik Group, and any other present or future member of “Focus Brands” group of companies worldwide even if they are not directly affiliated with Focus Brands.

Mobile Application: means a mobile application called Cinnabon Turkey Mobile Application that is run on mobile phones, tablet PCs and similar portable devices, provided that the license for the mobile application/software containing the virtual card has been given by Sadik Group to the Customer in a limited, non-exclusive and non-transferable way.

Program Collaborators: means any and all service providers, their affiliates, subsidiaries and other group companies as well as their respective employees that Sadik Group collaborate under this Program now or in future, including but not limited to Posta Guvercini, Microsoft Azur ve Protel Bilgisayar A.Ş. (“Protel”).

Cinnabon Turkey Card: means Cinnabon Turkey Virtual Card.

Cinnabon Turkey Virtual Card: means the virtual card which works as an additional corporate card created under the Application downloaded to the Member’s personal device (mobile phone, tablet etc) with the purpose to allow the User to become eligible to any and all campaigns and promotions in Cinnabon Turkey stores to be determined by Sadik Group, to win/spend points, to be eligible for gift vouchers and to take advantage of discount offers;

Member: is an individual who becomes a Cinnabon Turkey Card Program Visitor or Mobile Application visitor or content provider and/or mobile application user by marking the box(es) next to the following legend and/or a similar statement (“I have read and accept the User Agreement”) during the Membership registration of Cinnabon Turkey Card Program and whose personal details are given by him in the spaces on the Mobile Application.

Membership Details: means any personal data of the Member, including but not limited to, his name and surname, mobile phone number, e-mail, security question, Turkish Republic ID number, birth date and gender.

Star Data: means such campaign data including but not limited to eligibility to any campaigns and promotions, winning/spending points, eligibility for gift vouchers and discount offers that the Member may have the opportunity to take advantage of as a result of his use at Cinnabon Turkey stores to be determined by Sadik Group via Cinnabon Turkey Virtual Card.

GENERAL TERMS

The Member agrees and presents that he is older than 18 years old and is of the age pursuant to Turkish Code of Commerce.
Cinnabon Turkey and Application are the property of Sadik Group. All application-related services are provided by Sadik Group and/or its Program Collaborators authorized by it.
In order to use Cinnabon Turkey Card, the Member is required to fill in and approve this application form and should be saved as described in the Application.
To be able to use the Cinnabon Turkey Card, Member must scan the QR code in his mobile application at Cinnabon Turkey stores to accumulate stars/points.
Cinnabon Turkey Card is personal to the Member and may not be transferred to third parties. Advantages that the Member becomes eligible under the Program may not be transferred to any non-Program card nor may they be used instead of cash.
Where Cinnabon Turkey Virtual Card/the Device containing the Application is stolen, lost or becomes out of order beyond use, the Member shall notify Sadik Group without any undue delay by calling contact line no. (+90 212 809 40 92) . The Member shall be responsible for all losses that may arise until the notice. Upon the notice, Cinnabon Turkey Virtual Card shall be deactivated by Sadik Group into passive form.

BALANCE AMOUNT, ADVANTAGES AND CARD TERM INFORMATION

Member shall start to accumulate Advantages on the first purchase to be made following the downloading and activation of the Application in Cinnabon Turkey Virtual Card use. In order to make use of these advantages, this application form should be filled in and approved by the Member.
Advantages under Cinnabon Turkey Virtual Cards shall expire five (5) years after the approval by the Member of this Agreement.
Application and Cinnabon Turkey Card terms of use as well as advantages provided by it and the term of Cinnabon Turkey Card are determined by Sadik Group. Sadik Group may change these terms of use at any time at its sole discretion without any need to give a prior notice to the Member.

PERSONAL DATA, PROCESS AND TRANSFER OF SUCH DATA

The Member agrees, represents and undertakes that by accepting this Agreement, his personal data which may be provided by him during the term of the Program or which are acquired by any means during the use of the Application, including but not limited to his name, surname, address, telephone number, ID number, birth date and e-mail address are true and correct; that he understands that such data may also contain personal data or sensitive personal data; that in connection with such data and pursuant to Articles 10 and 11 of the Personal Data Protection Law no. 6698, he has the right to inquire whether or not his personal data are processed; that if the answer is yes, then to ask information about it; to inquire the purpose of processing his personal data and if such data are used in line with their intended purpose; to know third parties to whom personal data are transferred in Turkey or abroad; to ask the correction of his under-processed or misprocessed personal data; to ask that his personal data should be deleted or destroyed in line with such terms and requirements set out Article 7 of the Law no. 6698 and applicable legislation; to ask that corrections to and deletions of his personal data should be notified to third parties to whom personal data are transferred; to object any unfavourable outcome against him due to the analysis of processed data exclusively by automatic systems and to ask for the compensation and redressing of his losses that he may suffer on account of unlawful processing of his personal data.
Membership Details that may be collected following the expiry of the designated or necessary time shall be anonymized and/or deleted by Sadik Group in line with the applicable legislation. Sadik Group shall announce its changes and policies about the protection of personal data to the Members via Application notifications.
In case the Member wishes to get information about the Membership Details, to change, delete, edit or correct them or to withdraw his consent as to the transmission of commercial electronic messages he should visit www.cinnabon.com.tr
In case the future use of the Application turns out to be impossible for any reason whatsoever due to changes to the applicable law during the use of the Program and Application, Cinnabon Turkey Card Program automatically becomes null and void.
The Member agrees, represents and undertakes that he shall not disclose Cinnabon Turkey Card Application or any associated user name and/or password assigned to him to any party nor shall he allow their use; that he shall be responsible for safekeeping them; that Sadik Group’s liability as to the protection of the Member’s Personal Data shall be limited by the provisions defined in the Personal Data Protection Law no. 6698; that in case the Card/Application is misused by third parties and/or the member in any manner whatsoever, Sadik Group shall have the right to immediately terminate the membership provided that all its legal rights remain reserved; that in such a case he may lose all his rights arising from the Membership; that all rights and gains associated with his Membership shall be reclaimed back; that all measures may be applied and all present/future disputes arising from this application shall be borne by the Member in full.

COMMON PROVISIONS

All intellectual and industrial property rights of the Application shall be the property of Sadik Group. Unless otherwise is stated, intellectual and industrial property rights/copyrights of logo, trade mark, names, domain names, event page and other components in the Application as well as the license to use them shall exclusively belong to Sadik Group solely. Unless otherwise is specifically state, conditions written here shall not entitle a Member to use or have a disposition on them. The Member may in no event copy, distribute or add any contents subject to copyrights and other intellectual property rights, or trade marks or other proprietary information to the Application without the prior written consent of their owner.
Sadik Group’s all commitments related to the Program and Application are limited to this Agreement and except for the ones set out herein, it has not made any express or implied warranty about the Application or the Program including but not limited to its success, error-free, continuity.

3.In case of disputes, Sadik Group’s trade books and records shall constitute conclusive evidence; Istanbul Central (Cağlayan) Courts and Execution Offices shall have jurisdiction over any dispute.

I hereby agree, represent and undertake all conditions listed above in bullets which are applicable for and related to Cinnabon Turkey Card Program and its use.
